Bankruptcy / bankrupt are terms that have been misused by very many people on a daily basis to mean different things to different people. Some take it to mean a situation when one has no money in his or pocket temporarily.

A business becomes bankrupt when he/she is declared bankrupt by a competent court of law. A competent court of law is a law court that has the jurisdiction to handle bankruptcy cases.

Bankruptcy is a legally declared state in which one’s assets cannot cover all his liabilities. This can happen to both individuals and companies- after all, companies are legal persons in the eyes of the law. The person or the company will stay in this state for at least a period of ten years before being fully discharged.

A person ceases to be that same old person. What this implies is that an individual loses right to almost every thing s/he has. Your bank account, houses, cars, in fact, every thing that can be traced back to you will be confiscated. That is, those things that you have title to.

Some unscrupulous people have in the past taken advantage of the loopholes in the then bankruptcy Act to defraud their fellow citizens off their hard earned money.

They will voluntarily submit themselves for bankruptcy procedures to commence. They acquire properties of all kinds in different names prior to reporting themselves for bankruptcy procedures to commence.

These loopholes has reasonably blocked through the enactment of various laws that govern the six different broad kinds of bankruptcy.

These set of people fail to realise the un-quantified cost attached to being bankrupt. This include; tarnished image, restricted movement, lose of private life as you can only run bank accounts according to the prevailing law.

My standard advice for my clients is to avoid bankruptcy as much as they can. Simple financial management tips and personal finance tips should help ensure that you stay out of bankruptcy.
